Tracker Guidance
When the Commission formally requests access for a regulatory evaluation under Article 92, provide access to the GPAI model through the technical means, tools, components and conditions stated in the decision, which may include APIs, internal access, source code, model weights, hosting infrastructure or system-state access. Do not impose technical or other constraints that materially impede the evaluation, comply with any lawful requirement concerning evaluation logging, and provide the requested access without undue delay and within the deadline in the decision.
Official text
3. For the purposes of paragraph 1, the Commission may request access to the general-purpose AI model concerned through APIs or further appropriate technical means and tools, including source code. 4. The request for access shall state the legal basis, the purpose and reasons of the request and set the period within which the access is to be provided, and the fines provided for in Article 101 for failure to provide access. 5. The providers of the general-purpose AI model concerned or its representative shall supply the information requested. In the case of legal persons, companies or firms, or where the provider has no legal personality, the persons authorised to represent them by law or by their statutes, shall provide the access requested on behalf of the provider of the general-purpose AI model concerned.
1. Where the Commission adopts a decision requesting access to a general-purpose AI model pursuant to Article 92(3) of Regulation (EU) 2024/1689, that decision shall specify the technical means, tools, components, and conditions, including the time limit, by which the provider shall provide such access. The decision may also specify minimum technical requirements, including as regards performance, latency and throughput required to conduct the evaluation. 2. The access requested shall be appropriate to the objectives of the evaluation. Such access may include access through application programming interfaces (‘APIs’), internal access, access to source code, access to model weights, access to the infrastructure used for hosting the general-purpose AI model, access to inspect and modify the system state during interaction with the model. Such access may include but is not limited to all levels of access granted to employees of the provider. Providers of general-purpose AI models requested to provide access shall ensure that the access provided is not subject to technical or other constraints that materially impede an appropriate evaluation. 3. The Commission may require the provider to disable any logging measures that could track or record the Commission’s access to the general-purpose AI model, to the extent necessary to ensure the integrity and confidentiality of the evaluation process. 4. Providers of general-purpose AI models requested to provide access pursuant to Article 92(3) of Regulation (EU) 2024/1689 shall provide such access without undue delay and within the time limit established in the decision taken pursuant to paragraph 1, enabling the Commission to access all the elements of the general-purpose AI model concerned which are necessary to achieve the objectives set out in Article 92(1) of Regulation (EU) 2024/1689.
